End User License Agreement
Notice: Please read this End User License Agreement carefully before installing or using AuctionSieve ("the Software"). Hashbang Pty Limited ("Hashbang") is willing to license the software only upon the condition that you accept all of the terms contained in this End User License Agreement. By installing, copying, or otherwise using the Software Product, you agree to be bound by the terms of this License Agreement. If you do not agree to the terms of this agreement, do not install or use the Software Product.
AuctionSieve may be freely distributed, provided the distribution package is not modified. No person or company may charge a fee for the distribution of AuctionSieve without written permission from the copyright holder.
As long as you comply with the terms and conditions of this Agreement, Hashbang hereby grants you a world-wide nonexclusive license to install, store and load the Software.
You may not yourself and may not permit or enable anyone to: (i) modify or translate the Software; (ii) reverse engineer, decompile, or disassemble the Software or otherwise reduce the Software to a form understandable by humans, except to the extent this restriction is expressly prohibited by applicable law notwithstanding this limitation; (iii) rent, lease, loan, resell or create derivative works based on the Software; (iv) merge the Software with another product; or (vii) remove or obscure any proprietary rights notices, labels, copyrights, trademarks, servicemarks, confidentiality notices and/or restricted rights notices on or in the Software.
Disclaimer of warranty and Limitation of liability
THIS SOFTWARE IS PROVIDED "AS IS" AND ANY EXPRESSED OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. IN NO EVENT SHALL HASHBANG BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
Special Terms and Restrictions of Use
Hashbang may, at its sole discretion, at any time, without prior notice and temporarily or permanently:
(i) terminate, limit or deny the License
(ii) change, reduce or limit the functionality and features of AuctionSieve
(iii) create different priorities or grades for different users
(iv) introduce new features that may cause functionality change in earlier versions.
