BLACKJACK SYSTEMS ANALYST End User License Agreement License Agreement: This End User License Agreement (EULA) is a legal agreement between BlackjackSim.com and the end user, whether an individual or entity. If you install Blackjack Systems Analyst (Software) onto any electronic storage media you are agreeing to be bound by the terms of this licensing agreement. If you do not agree to be bound by the terms of this agreement then do not use this Software and destroy all copies in your possession. 1. This EULA grants you, the End User, a non-exclusive, limited license to install the Software onto one domain. Sub-domains and main domains are considered as 1 domain. You may purchase more licenses from BlackjackSim.com webpage. 2. The End User may make one back-up copy of the Software. Modifications: You are NOT authorized to make any modifications to the code. You may not distribute the code without BlackjackSim.com permission. License Restrictions: 1. The End User may not sell, rent, sub-license, assign, transfer, lease, sublease, modify, translate, digitally transfer, disassemble, decompile, reverse engineer or create derivative works based upon the Software. 2. BlackjackSim.com may terminate this license agreement if you fail to comply with this EULA. If this license agreement is terminated you must cease use of and destroy all copies of the Software in your possession. Ownership: The End User is granted a limited use license through this EULA to use the Software. BlackjackSim.com reserves all rights and ownerships of all materials contained in this software product as well as all content on www.BlackjackSim.com. You may not claim intellectual or exclusive ownership to any of our content or products, modified or unmodified. This software is protected by United States Copyright and International Copyright laws. Other Provisions: Should any provision of this Agreement be held to be void, invalid, unenforceable or illegal by a court, the validity and enforceability of the other provisions shall not be affected thereby. If any provision is determined to be unenforceable, you agree to a modification of such provision to provide for enforcement of the provision's intent, to the extent permitted by applicable law. Failure of a party to enforce any provision of this Agreement shall not constitute or be construed as a waiver of such provision or of the right to enforce such provision. If you fail to comply with any terms of this Agreement, your license is automatically terminated and you must then destroy all copies of the Software in your possession. Limited Warranty: 1. BlackjackSim.com warrants that, for a period of thirty (15) days from the date of purchase, if properly installed and operated on hardware and software for which it is designed, the Software will perform substantially in accordance with the instructions. 2. Customer Remedies: Your remedy shall be replacement of the defective Software via e-mail, or download from the order processing website. 3. To make a warranty claim, contact BlackjackSim.com using the contact form on the webpage. This Limited Warranty is void if failure of the Software has resulted in whole or in part from accident, abuse, misapplication or violation of this Agreement. In no event shall BlackjackSim.com be liable for any damages or losses including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products. Any replacement SOFTWARE will be warranted for the remainder of the original warranty period or fifteen (15) days, whichever is longer. This warranty allocates risks of product failure between Licensee and BlackjackSim.com. THERE ARE NO OTHER WARRANTIES. BLACKJACKSIM.COM DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THE SOFTWARE AND ITS INSTRUCTIONS. BLACKJACKSIM.COM DOES NOT WARRANT THE PRODUCT TO WORK WITH 3RD PARTY COMPONENTS, MODULES OR EXTENSIONS. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND MAY HAVE OTHERS, WHICH VARY FROM JURISDICTION TO JURISDICTION. BLACKJACKSIM.COM DOES NOT WARRANT THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED, ERROR FREE OR MEET LICENSEE'S SPECIFIC REQUIREMENTS. THE WARRANTY SET FORTH ABOVE IS IN LIEU OF ALL OTHER EXPRESS WARRANTIES WHETHER ORAL OR WRITTEN.
