Driver Talent for Network Card End User License Agreement (EULA) is a legal agreement between you (either an individual or a single entity) and Driver Talent for Network Card for OSToto Co., Ltd. The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.
1. GRANT OF LICENSE
The SOFTWARE PRODUCT is licensed as follows:
(a) Installation and Use
OSToto Co., Ltd. grants you the right to install and use copies of the SOFTWARE PRODUCT on your computer running a validly licensed copy of the operating system for which the SOFTWARE PRODUCT was designed [e.g., Windows XP, Windows Vista, Windows 7, Windows 8].
(b) Backup Copies
You may also make copies of the SOFTWARE PRODUCT as may be necessary for backup and archival purposes.
2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS
(a) Maintenance of Copyright Notices
You must not remove or alter any copyright notices on any and all copies of the SOFTWARE PRODUCT.
(b) Prohibition on Reverse Engineering, Decompilation, and Disassembly.
You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
(c) Support Services
OSToto Co., Ltd. may provide you with support services related to the SOFTWARE PRODUCT ('Support Services'). Any supplemental software code provided to you as part of the Support Services shall be considered part of the SOFTWARE PRODUCT and subject to the terms and conditions of this EULA.
(d) Compliance with Applicable Laws
You must comply with all applicable laws regarding use of the SOFTWARE PRODUCT.
3. TERMINATION
This EULA is effective until terminated. Your rights under this License will terminate by Us automatically without notice if You fail to comply with any term(s) of this EULA. Upon the termination of this License, You shall cease all use and destroy, remove or delete all copies, full or partial, of the Software on Your computer or device and otherwise in Your possession or control.
4. DISCLAIMER OF WARRANTIES
You assume the entire risk as to the use, quality and performance of the software. The software and accompanying written material are provided on an 'As is' and 'As available' basis without warranty of any kind, express or implied of any kind OSToto Co., Ltd. Specifically disclaim warranties if fitness for a particular purpose, merchantability and non-infringment of any third party rights. No oral or written advice given by OSToto Co., Ltd. Its dealers, distributors, agents or employees shall create a warranty or in any way increase the scope of this warranty and you may not reply upon such information or advice.
5. LIMITATION OF LIABILITY
To the extent not prohibited by applicable law, in no event shall OSToto Co., Ltd. be liable to you or a third party for personal injury, or any incidental, special, indirect or consequential damages for loss of profits, loss of data or information. Business interruption or any other commercial damages or losses, arising out of or related to your use or inability to use software or services or any third party software or applications in conjunction with the software however caused, regardless of the thory of liability (contract, tort or otherwise) and even if OSToto Co., Ltd. has been advised of the possibility of such damages. Some jurisdictions do not allow the limitation of the liability for personal injury, or of incidental or consequential damages, so this limitation may not apply to you.
OSToto Co., Ltd. shall have no liability with respect to the content of the SOFTWARE PRODUCT or any part thereof, including but not limited to errors or omissions contained therein, libel, infringements of rights of publicity, privacy, trademark rights, business interruption, personal injury, loss of privacy, moral rights or the disclosure of confidential information.
