END USER LICENSE AGREEMENT
This End User License Agreement (“Software License Agreement”) is a legal document between you and Fast Reports, Inc. (“Fast Reports”). It is important that you read this document before using the Fast Reports-provided software (“Software”) and any accompanying documentation, including, without limitation printed materials, ‘online' files, or electronic documentation
BY CLICKING ON THE "ACCEPT" BUTTON, OPENING THE PACKAGE, DOWNLOADING THE SOFTWARE, OR USING THE EQUIPMENT THAT CONTAINS THIS SOFTWARE, YOU ARE CONSENTING TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, CLICK THE "DO NOT ACCEPT" BUTTON AND THE INSTALLATION PROCESS WILL NOT CONTINUE. IN ADDITION: (1) IF YOU ARE OTHERWISE ATTEMPTING TO DOWNLOAD THE SOFWARE AND YOU DO NOT AGREE WITH THE TERMS OF THIS AGREEMENT, DO NOT COMPLETE THE DOWNLOAD; OR, (2) IF YOUR SOFTWARE WAS INCLUDED IN EQUIPMENT WHICH YOU PURCHASED AND YOU DO NOT AGREE WITH THE TERMS OF THIS AGREEMENT, DO NOT USE THE SOFTWARE.
Definitions
"Fast Reports" means Fast Reports, Inc. and its Licensors, if any.
"Software" means only the Fast Reports software program(s) and third party software programs, in each case, supplied by Fast Reports herewith, and corresponding documentation, associated media, printed materials, and online or electronic documentation, and all updates or upgrades of the above that are provided to you.
The Software is Copyright © 1998-2006 Fast Reports, Inc. You may use it and distribute it according to this following License Agreement. If you do not agree with these terms, please remove the Software from your system. By incorporating the Software in your work or distributing the Software to others you implicitly agree to these license terms.
The Software is protected by copyright laws as well as other intellectual property laws and treaties. The Software and the accompanying documentation are licensed, not sold, to you. This includes any updates or upgrades to the Software licensed to you by Fast Reports. If the Software is labeled as an upgrade, you must be properly licensed to use a product identified by Fast Reports as being eligible for the upgrade in order to use the Software. If the Software is an upgrade of a component of a package of software programs that you licensed as a single product, the Software may be used and transferred only as part of that single product package and may not be separated for use on more than one computer. Subject to the terms of this agreement, you have a non-exclusive and nontransferable right to use the Software and Documentation. This Software is "in use" on a computer when it is loaded into temporary memory or installed in permanent memory (Hard Drive, CD-ROM or other storage device).
You agree to use your best efforts to prevent and protect the contents of the Software and Documentation from unauthorized use or disclosure. You agree that you will register this Software and its Serial Number only with Fast Reports or one of its authorized distributors and that you will only install a Software License Key obtained directly from Fast Reports.
You may not rent, lease, sell or otherwise transfer or distribute copies of the Software to others, nor may you create derivative works of the Software. You may not modify or translate the Software or Documentation without the prior consent of Fast Reports. You may not reverse engineer, reverse compile, disassemble, or otherwise attempt to create the source code from the Software. The Customer agrees that aspects of the licensed materials, including the specific design and structure of individual programs, constitute trade secrets and/or copyrighted material of Fast Reports. The Customer agrees not to disclose, provide, or otherwise make available such trade secrets or copyrighted material in any form to any third party without the prior written consent of Fast Reports. Customer agrees to implement reasonable security measures to protect such trade secrets and copyrighted material. Title to the Software and Documentation shall remain solely with Fast Reports.
You may make copies of the Software and Software License for backup purposes. You may physically transfer the Software, Documentation, and Software License from one computer to another provided that the Software License is only installed and used on one computer at a time. Except as expressly provided in this EULA, you may not otherwise make copies of the Software, including the printed materials accompanying the Software.
This license is effective until terminated. You may terminate this license at any time by destroying the Software, Documentation, and Software License Key as well as each backup copy. Without prejudice to any other rights, Fast Reports may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the Software and all of its component parts. This license automatically terminates if you fail to comply with its terms and conditions.
You agree that Fast Reports may audit your use of the Software for compliance with these terms at any time, upon reasonable notice. In the event that such audit reveals any use of the Software by you other than in full compliance with the terms of this Agreement, you shall reimburse Fast Reports for all reasonable expenses related to such audit in addition to any other liabilities you may incur as a result of such non-compliance.
Your license rights under this EULA are non-exclusive.
NEITHER FAST REPORTS NOR ITS SUPPLIERS SHALL BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, COVER OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR THE INABILITY TO USE EQUIPMENT OR ACCESS DATA, LOSS OF BUSINESS, LOSS OF PROFITS, BUSINESS INTERRUPTION OR THE LIKE), ARISING OUT OF THE USE OF, OR INABILITY TO USE, THE SOFTWARE AND BASED ON ANY THEORY OF LIABILITY INCLUDING BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF FAST REPORTS OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

Fast Reports and other trademarks contained in the Software are trademarks or registered trademarks of Fast Reports, Inc. in Russian Federation and/or other countries. Third party trademarks, trade names, product names and logos may be the trademarks or registered trademarks of their respective owners. You may not remove or alter any trademark, trade names, product names, logo, copyright or other proprietary notices, legends, symbols or labels in the Software. This EULA does not authorize you to use Fast Reports' or its Licensors' names or any of their respective trademarks.
DISCLAIMER OF WARRANTY FOR SOFTWARE. EXCEPT FOR THE EXPRESS WARRANTIES SET FORTH IN THIS AGREEMENT, FAST REPORTS DISCLAIMS ALL IMPLIED WARRANTIES FOR THE SOFTWARE, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. FAST REPORTS MAKES NO REPRESENTATIONS CONCERNING THE QUALITY OF THE SOFTWARE AND DOES NOT PROMISE THAT THE SOFTWARE WILL BE ERROR FREE OR WILL OPERATE WITHOUT INTERRUPTION.
Fast Reports has and will retain all ownership rights in the Software, including all patent rights, copyrights, trade secrets, trademarks, service marks, related goodwill and confidential and proprietary information. Licensee will have no rights in the Software except as explicitly stated in this Agreement.
LICENSEE HAS READ THIS AGREEMENT AND UNDERSTANDS AND AGREES TO ALL OF ITS TERMS AND CONDITIONS.
