Hearthside Software License Agreement This software is protected by copyright law and international copyright treaties. If you keep or use this software, you are agreeing to the terms of this agreement. Appropriate use of this software follows: 1. Make copies of the software for personal backup purposes only. 2. Use and install the software on only one computer at a time. 3. You may transfer all of your rights to use the software to another person only if you give them all of the materials associated with this software and transfer to them or destroy all of your copies in any form that they may exist. 4. You are not permitted to modify or reverse engineer the software. This license is not a sale. Title and copyrights to the software remain with Hearthside Software and its licensors. Any breach terminates this Agreement. Limited Warranty Hearthside Software warrants the physical media to be free of defects for a period of ninety (90) days from the original purchase date. The entire and exclusive liability and remedy for breach of this limited warranty shall be limited to replacement of defective media and shall not include or extend to any claim for or right to recover any other damages, including but not limited to, loss of profit, data, or use of the software or special, incidental or consequential damages, or other claims. In no event will Hearthside Software's liability for any damages to you or any other person ever exceed the lower of the list price or the actual price paid for the package or the license to use the Software, regardless of the form of the claim. HEARTHSIDE SOFTWARE SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES, REPRESENTATIONS, OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OR CONDITION OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ALL OTHER IMPLIED TERMS ARE EXCLUDED. Specifically, Hearthside Software makes no representation or warranty that the software is "error-free," or meets any user's particular standards, requirements, or needs. Hearthside Software and its licensors shall not be liable for any incidental or consequential damages, including loss of data or other special or indirect damages. General Provisions The software is provided with Restricted Rights. Use, duplication, or disclosure of the software by the U.S. Government is subject to the restricted rights applicable to commercial computer software (under FAR 52.227-19 and DFARS 252.227-7013). The manufacturer is Hearthside Software, LLC, 400 Spring Creek Rd, Providence, UT 84332. This license agreement and limited warranty will be governed by the laws of the state of Utah. If any provision of this agreement is found void or unenforceable, the remainder of the agreement shall remain valid and enforceable. In the event of a breach of this licensing agreement, the breaching party shall pay all attorney's fees and costs associated with the enforcement for this agreement. Jurisdiction for enforcement of this agreement shall be the First Judicial District Court, Cache County, State of Utah, or any competent court in and for the state of Utah.
